General Liability Claim Checklist:
What to Do When an Accident Involves Bodily Injury or Property Damage

Use this claim checklist when someone other than a fair employee experiences bodily injury from an accident or when property not owned by the fair is damaged. You'll also find a copy of this checklist under General Liability, Tab 2, in your fair's Red Book (Claim and Loss Reporting Guide), supplied to you by California Fair Services Authority (CFSA).

Here's what to do in the event of an accident:

Provide all appropriate first aid or take steps to      prevent further property damage.

If possible, interview the injured person:
     Obtain the information necessary to complete both      sides of the "Accident Report (Other than Motor      Vehicle)." Include a version of what happened from      the point of view of the involved party(ies), in      addition to your own observations of what their      injuries appear to be and their physical appearance      (i.e. Do they appear to have been drinking? If they      slipped on a spilled substance, are their clothes wet?      What type of shoes are they wearing?). Do not      promise to pay any bills.

Inspect the scene of the accident; if injuries are       serious, preserve evidence. We never know when      injured parties may try to exaggerate their claims or      take advantage of their injuries. Because of this,      except for the most minor accidents, someone should      be dispatched to the scene of the incident. Note in      detail any conditions related to the accident (i.e. the      nature and size of any spill, the size and depth of a      pothole, available lighting). Fully identify any      witnesses and document their version(s) of what      happened. (Friends and relatives could change their      story later.) Photos of the scene, especially if the fair      or event is about to end, are very helpful.

Label and save any physical evidence.

Complete an Accident Report (Other than Motor       Vehicle). Be sure to identify who at the fair has the      most knowledge about the incident, the specific      location of the incident on the grounds and all      involved person(s). Also note if the injured party was      a participant in an event.

Send the completed Accident Report to:       California Fair Services Authority Liability Claims      Department: P.O. Box 15518 Sacramento, CA
     95852-0518. Fax: (916) 263-6159. (Make sure you          retain a copy for your files.) Most important, don't      wait until the end of the fair or for missing information      to send in your report.

Attach copies of any related contract and proof
      of
insurance to your report. If copies will be
     available later, send them when you get them to
     California Fair Services Authority (CFSA). Make sure
     you include the injured person's name for reference.

Immediately report accidents involving serious
      injuries
to CFSA's Claims Department to Rosalyn
     Johnson at (916) 263-6171 during normal business
     hours. After normal business hours, call (916)
     921-2213 for further instructions.
